Foreclosure

Behind on payments? There's still time.

A foreclosure does not happen the day you miss a payment. There is a window, and inside that window you have options. Selling to us is one of them.

    How foreclosure works in Massachusetts

Massachusetts is a non-judicial foreclosure state, which means the lender does not have to sue you, but they do have to follow a process: a 90-day right-to-cure notice, then a notice of sale published in the paper and mailed to you at least 14 days before the auction. From the first missed payment to the auction is usually six months to a year, sometimes longer. We lay out each stage, with typical timing, in our Massachusetts foreclosure timeline guide.

Right up until the auction happens, you can still sell the house and pay the lender off. That is the part most people do not realize.

What a sale does for you

If you sell before the auction, the mortgage, the late fees, and the lender's legal costs get paid out of the sale price at closing. Whatever is left is yours. A foreclosure, by contrast, wipes out your equity, stays on your credit for seven years, and in Massachusetts the lender can come after you for the shortfall if the auction does not cover the debt.

We move fast because we have to. No bank on our side, no appraisal, no financing contingency. If you call us with three weeks to the auction, we can usually get it done. Two weeks is tight but possible. The day before, no.

What about a tax lien or a tax title taking?

Same story with the town. If you owe back taxes and the town has started a tax title process, we can pay the taxes off at closing and stop it. Towns like Brockton, New Bedford, and Fall River are aggressive about this. Do not wait for the court date.

    What we will not do

We will not pretend to be your friend and then take advantage of you. We will tell you what the house is worth, what you owe, and what you would walk away with. If the numbers do not work, we will say so and point you to other options, including the Massachusetts Attorney General's HomeCorps program and HUD-approved housing counselors who help for free.

If you need to sell your house fast in Massachusetts for any other reason, that page covers the whole process.

    Questions

    Common questions

    How late is too late?

Once the auction happens, it is done. Before that, call. Even with a week left there are sometimes options.

Will the lender let me sell?

Yes. The lender wants to be paid, not to own your house. You do not need their permission to sell as long as the sale covers what you owe.

What if I owe more than the house is worth?

That is a short sale, and it requires the lender to agree to take less. We have done them. They take longer and they are not guaranteed, but they are a lot better than a foreclosure.
